1. Il servizio

EasyMedia aiuta negozi e professionisti a creare immagini, video e testi per Instagram, TikTok e Xiaohongshu nello stile del proprio negozio. Il servizio non pubblica nulla al posto tuo e non chiede le password dei tuoi profili social: scarichi i contenuti e li pubblichi tu. EasyMedia non è affiliato a Instagram, TikTok o Xiaohongshu; i loro nomi e marchi appartengono ai rispettivi titolari.

2. Account

Devi avere almeno 18 anni e fornire un indirizzo email valido. Sei responsabile della sicurezza della tua password e di ciò che avviene con il tuo account. Il titolare di un'azienda su EasyMedia è responsabile dei membri che invita e dei permessi che assegna. Se usi il servizio per conto di un'impresa, dichiari di avere il potere di accettare questi termini per essa.

3. Fase di prova gratuita e limiti

Durante la fase di prova il servizio è gratuito e soggetto a limiti giornalieri di generazione. Possiamo modificare i limiti, le funzioni e i modelli AI usati, o sospendere il servizio, anche senza preavviso quando necessario per motivi tecnici o di sicurezza. Eventuali piani a pagamento saranno introdotti solo con avviso preventivo e non verranno applicati senza la tua accettazione.

4. I tuoi contenuti

Le foto, i testi e gli altri materiali che carichi restano tuoi. Ci concedi il permesso, limitato a quanto necessario per fornirti il servizio, di conservarli, elaborarli e inviarli ai fornitori AI per generare i contenuti. Dichiari di avere tutti i diritti necessari su ciò che carichi, compreso il consenso delle persone riconoscibili nelle foto, e di non violare diritti di terzi (diritto d'autore, marchi, immagine, privacy).

5. Contenuti generati

Nei limiti consentiti dalla legge, i contenuti generati per te possono essere usati da te liberamente, anche a fini commerciali, e ti cediamo gli eventuali diritti che potremmo avere su di essi. I contenuti sono creati da sistemi di intelligenza artificiale: possono essere imprecisi, simili a contenuti creati per altri o non tutelabili come opere originali. Prima di pubblicarli devi verificarli e assicurarti che siano veritieri (ad esempio prezzi, ingredienti, allergeni, promozioni) e conformi alla legge e alle regole delle piattaforme. Sei responsabile di ciò che pubblichi.

6. Usi vietati

Non puoi usare EasyMedia per:

• creare contenuti illegali, ingannevoli, diffamatori, d'odio, violenti o sessualmente espliciti, o qualsiasi contenuto che coinvolga minori in modo inappropriato;
• pubblicità ingannevole, recensioni false o impersonare persone o aziende;
• violare diritti di terzi o caricare dati personali di altri senza base legale;
• aggirare i limiti, la verifica anti-bot o le misure di sicurezza, accedere a dati di altri utenti, o decompilare o sovraccaricare il servizio.

7. Sospensione e chiusura

Puoi eliminare il tuo account in qualsiasi momento dall'app. Possiamo sospendere o chiudere un account che viola questi termini o la legge, o che mette a rischio il servizio o altri utenti; quando possibile ti avviseremo prima.

8. Garanzie e responsabilità

Il servizio è fornito "così com'è", in particolare durante la fase di prova gratuita, senza garanzia di disponibilità continua o di risultati specifici. Nei limiti consentiti dalla legge non rispondiamo di danni indiretti, perdita di profitti o di dati, né dei contenuti che decidi di pubblicare. Nulla in questi termini limita la nostra responsabilità per dolo o colpa grave, né i diritti che la legge riconosce ai consumatori.

9. Modifiche ai termini

Possiamo aggiornare questi termini. Per le modifiche importanti ti avviseremo nell'app o via email con un ragionevole preavviso; se continui a usare il servizio dopo la data indicata, accetti i nuovi termini. Se non li accetti puoi eliminare l'account.

10. Legge applicabile e foro

Questi termini sono regolati dalla legge italiana. Se sei un consumatore, è competente il giudice del luogo della tua residenza o domicilio e restano salve le norme inderogabili a tua tutela. In tutti gli altri casi è competente in via esclusiva il Foro di Venezia.

EasyMedia helps stores and professionals create images, videos and texts for Instagram, TikTok and Xiaohongshu in their own store's style. The service does not publish anything on your behalf and does not ask for your social media passwords: you download the content and publish it yourself. EasyMedia is not affiliated with Instagram, TikTok or Xiaohongshu; their names and trademarks belong to their respective owners.

2. Account

You must be at least 18 years old and provide a valid email address. You are responsible for keeping your password safe and for what happens with your account. The owner of a company on EasyMedia is responsible for the members they invite and the permissions they grant. If you use the service on behalf of a business, you confirm that you are authorised to accept these terms for it.

3. Free trial and limits

During the trial phase the service is free and subject to daily generation limits. We may change limits, features and the AI models used, or suspend the service, without notice where necessary for technical or security reasons. Any paid plans will be introduced only with prior notice and will not apply without your acceptance.

4. Your content

The photos, texts and other materials you upload remain yours. You grant us permission, limited to what is needed to provide the service, to store and process them and to send them to AI providers to generate content. You confirm that you hold all necessary rights to what you upload, including the consent of identifiable people in photos, and that it does not infringe the rights of others (copyright, trademarks, image rights, privacy).

5. Generated content

To the extent permitted by law, you may use the content generated for you freely, including commercially, and we assign to you any rights we may have in it. Content is created by artificial intelligence systems: it may be inaccurate, similar to content created for others, or not protectable as an original work. Before publishing you must review it and make sure it is truthful (e.g. prices, ingredients, allergens, promotions) and complies with the law and platform rules. You are responsible for what you publish.

6. Prohibited uses

You may not use EasyMedia to:

• create illegal, misleading, defamatory, hateful, violent or sexually explicit content, or any content involving minors inappropriately;
• run misleading advertising, write fake reviews or impersonate people or businesses;
• infringe the rights of others or upload other people's personal data without a legal basis;
• bypass limits, the anti-bot check or security measures, access other users' data, or reverse engineer or overload the service.

7. Suspension and termination

You can delete your account at any time in the app. We may suspend or close an account that breaches these terms or the law, or that puts the service or other users at risk; where possible we will warn you first.

8. Warranties and liability

The service is provided "as is", especially during the free trial, with no guarantee of continuous availability or specific results. To the extent permitted by law we are not liable for indirect damages, loss of profits or data, or for content you choose to publish. Nothing in these terms limits our liability for wilful misconduct or gross negligence, or the rights granted to consumers by law.

9. Changes to these terms

We may update these terms. For significant changes we will notify you in the app or by email with reasonable notice; if you keep using the service after the stated date, you accept the new terms. If you do not accept them you can delete your account.

10. Governing law and jurisdiction

These terms are governed by Italian law. If you are a consumer, the courts of your place of residence or domicile have jurisdiction and the mandatory rules protecting you still apply. In all other cases the courts of Venice (Italy) have exclusive jurisdiction.

2. 账号

你必须年满 18 周岁，并提供有效邮箱。你要负责保管好密码，并对账号下发生的操作负责。在 EasyMedia 上创建公司的老板，要对自己邀请的成员和分配的权限负责。如果你代表企业使用本服务，即表示你有权代表该企业接受本条款。

3. 免费试用和使用上限

试用期间服务免费，并有每日生成上限。出于技术或安全需要，我们可能调整上限、功能和所用的 AI 模型，或暂停服务，必要时不另行通知。如以后推出付费方案，会提前通知，未经你同意不会向你收费。

4. 你的内容

你上传的照片、文字和其他资料仍归你所有。你授权我们在提供服务所需的范围内保存、处理这些内容，并发送给 AI 服务商用于生成。你保证对上传内容拥有全部必要权利（包括照片中可识别人物的同意），且不侵犯他人的著作权、商标、肖像或隐私等权利。

5. 生成的内容

在法律允许的范围内，为你生成的内容你可以自由使用，包括商业用途，我们对其可能享有的权利也一并转让给你。内容由人工智能生成，可能不准确，可能与为他人生成的内容相似，也可能无法作为原创作品受到保护。发布前你必须自行检查，确保内容真实（例如价格、配料、过敏原、优惠活动），并符合法律和各平台规则。你对自己发布的内容负责。

6. 禁止的用途

你不得用 EasyMedia：

• 生成违法、误导、诽谤、仇恨、暴力或色情内容，或任何以不当方式涉及未成年人的内容；
• 做虚假广告、写虚假评价，或冒充他人或其他企业；
• 侵犯他人权利，或在没有合法依据的情况下上传他人个人信息；
• 绕过使用上限、人机验证或安全措施，访问其他用户的数据，或对服务进行反编译、恶意请求。

7. 暂停和终止

你可以随时在 App 中删除账号。对违反本条款或法律、或危害服务及其他用户的账号，我们可以暂停或关闭；条件允许时会事先通知你。

8. 保证和责任

本服务按"现状"提供，尤其在免费试用期间，不保证持续可用或达到特定效果。在法律允许的范围内，我们不对间接损失、利润或数据损失，以及你自行决定发布的内容承担责任。本条款不限制我们因故意或重大过失应承担的责任，也不影响法律赋予消费者的权利。

9. 条款修改

我们可能更新本条款。重要修改会在 App 内或通过邮件提前合理时间通知你；在通知的日期之后继续使用服务，即视为接受新条款。如不接受，你可以删除账号。

10. 适用法律和管辖

本条款适用意大利法律。如果你是消费者，由你住所地或居所地的法院管辖，并适用保护消费者的强制性规定；其他情况下由威尼斯法院专属管辖。
